GENERAL
ART 1
Seller = Babashop
Buyer = customer, buyer
ART 2
Buyer hereby declares to be competent to purchase with all thereby resulting (payment) obligations and liabilities.
ART 3
A legally valid order contains:
- Name buyer
- E-mail address buyer
- delivery address buyer
ART 4
Displayed prices are including VAT, excluding shipping costs.
ART 5
All by seller delivered goods stay property of the seller until buyer has complied with all (payment) obligations.
ART 6
Seller is authorized to suspend all of his obligations or to dissolve the agreement if:
- Buyer does not, not in time or not fully comply to the obligations of the agreement.
ART 7
Following situations can never be the cause of any reclamations:
- difference in color
- print errors
- change in backprint band teeshirts
- sizes of band teeshirts
ART 8
Seller can, without providing any reason, deny an order.
ART 9
Special offers are not valid with back orders.
ART 10
Seller is entitled to send orders in parts, and to bill these partial-deliveries separately (product + shipping costs).
ART 11
When the buyer denies to purchase, seller is entitled to store the product for charge and risk of the buyer.
SHIPPING AND RETURNS
ART 1
The product will be send after reception/confirmation of payment.
ART 2
If buyer wishes to cancel after payment but before delivery, 10% of the agreed order price will be charged to the buyer, including VAT.
ART 3
If the period between placing the order and making the payment is longer then 1 week, the product will no longer be reserved.
ART 4
Ordered and accepted products can not be returned.
ART 5
Possible damage on the received products must be reported within 4 days. These products can be returned and replaced by a voucher or refund (excl. shipping costs).
ART 6
Shipping costs of returns in case of damage will be half paid by the seller. In case of a wrong size, the shipping costs will be fully charged to the buyer. If the seller has to send a new size the shipping costs will be half paid by the seller.
ART 7
If buyer has ordered and paid for a product that is offered on the mailorder site, but does not appear to be in stock because the site has not registered this yet, the buyer can receive a refund. Buyer can also wait for the product to get back in stock again, and/or receive a voucher for this or another product.
ART 8
Restock can take 1 week to 10 weeks.
